1. Intellectual Property Rights
The Homefix website, mobile application, and all associated digital platforms (collectively, the “Platform”), including all text, graphics, logos, images, software, designs, layouts, product descriptions, and related content, are owned by or licensed to Homefix and are protected under applicable Canadian and international intellectual property laws.
For the purposes of these terms and conditions, “Homefix” includes Homefix, its affiliates, subsidiaries, contractors, service providers, successors, and assigns.
Homefix grants users a limited, revocable, non-transferable, and non-exclusive right to access and use the Platform solely for personal and lawful purposes related to Homefix services.
Users may not:
- Copy, reproduce, distribute, republish, upload, display, transmit, license, sell, or exploit Platform content.
- Use automated systems, bots, crawlers, scraping tools, or extraction technologies.
- Modify, reverse engineer, or create derivative works from the Platform.
- Use Homefix trademarks, logos, or branding without written permission.
2. Acceptable Use of the Platform
By accessing or using the Platform, users agree to comply with these terms and all applicable laws.
Users agree not to:
- Use the Platform for unlawful, fraudulent, misleading, or abusive purposes.
- Misrepresent their identity, affiliation, or authorization.
- Interfere with Platform operation, security, or functionality.
- Attempt unauthorized access to systems, networks, or accounts.
- Upload malicious code, viruses, or harmful software.
- Create unreasonable demand on Homefix infrastructure.
- Collect or use Platform information for unauthorized commercial purposes.
Homefix reserves the right to suspend, restrict, terminate, or refuse access where misuse, fraud, unlawful activity, or violations are identified.
3. General Terms of Use
By requesting, scheduling, or purchasing services through Homefix, users agree to pay all applicable fees, taxes, deposits, and charges associated with requested services.
Users represent and warrant that:
- All information provided is accurate and complete.
- The selected payment method is valid and authorized.
- Services will be used for lawful purposes only.
Homefix reserves the right to reject bookings, limit service availability, cancel transactions, or suspend accounts at its sole discretion.
4. Product Information Policy
Homefix strives to provide accurate and reliable information regarding products, materials, pricing, specifications, availability, compatibility, installation requirements, warranties, and related services.
Certain Platform content may be generated, assisted, summarized, or enhanced through artificial intelligence (AI) systems or automated technologies.
AI-generated information may occasionally:
- Contain inaccuracies or omissions.
- Be incomplete or outdated.
- Generate incorrect recommendations.
- Misinterpret user inputs.
- Display incorrect pricing or specifications.
Users are responsible for independently verifying:
- Product specifications.
- Measurements and dimensions.
- Compatibility requirements.
- Safety instructions.
- Manufacturer guidelines.
- Installation procedures.
- Applicable building codes.
- Permit requirements.
- Professional recommendations.
Homefix reserves the right to update, modify, remove, or correct any information on the Platform without notice.
5. Service and Delivery Availability
Service and delivery availability may vary based on location, scheduling capacity, inventory, contractor availability, weather conditions, transportation delays, supplier limitations, and other operational factors.
Homefix does not guarantee uninterrupted availability of services, delivery dates, installation timelines, or completion schedules.
6. Pricing Accuracy Policy
All prices displayed on the Platform are listed in Canadian Dollars unless otherwise stated.
Quoted pricing may exclude:
- Applicable taxes.
- Permit or licensing fees.
- Disposal or environmental fees.
- Delivery or transportation charges.
- Additional labour or material costs.
Homefix reserves the right to correct pricing errors, inaccuracies, omissions, or outdated information and may modify or cancel bookings where necessary.
7. Return Policy
All sales, service bookings, custom orders, deposits, installation fees, labour charges, delivery charges, and related purchases are final and non-refundable unless otherwise required by law.
Homefix does not accept returns, exchanges, or refunds for:
- Completed services.
- Special order items.
- Custom-made products.
- Used, opened, installed, or damaged products.
- Clearance or final sale items.
- Digital products.
- Products supplied by third parties.
8. Scheduling, Rescheduling, and Cancellations
Appointments and service dates are subject to availability.
Homefix may delay, reschedule, or cancel services due to:
- Weather conditions.
- Safety concerns.
- Material shortages.
- Contractor scheduling conflicts.
- Emergencies.
- Events beyond reasonable control.
Cancellation fees, rescheduling charges, or deposit forfeitures may apply.
9. Payment Processing Policy
- Users authorize Homefix to charge designated payment methods for applicable amounts.
- Homefix may require deposits, staged payments, or pre-authorizations.
- Failure to pay may result in delays, cancellations, account restrictions, or additional charges.
10. User Information Policy
Certain Platform features may require account registration.
Users are responsible for:
- Maintaining account confidentiality.
- Restricting unauthorized access.
- All activity occurring under their account.
Users must notify Homefix immediately of any unauthorized use or security breach.
11. Third-Party Websites and Services
The Platform may contain links to third-party websites, applications, or services. Homefix does not control or assume responsibility for third-party content, privacy practices, security, availability, or products and services.
12. User Generated Content
Users may submit reviews, comments, photos, videos, feedback, or other content.
By submitting content, users grant Homefix a perpetual, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to use, reproduce, modify, publish, distribute, and create derivative works from such content.
13. Limitation of Liability and Warranties
The Platform and all services are provided on an “as is” and “as available” basis without warranties of any kind.
Homefix disclaims warranties including:
- Merchantability.
- Fitness for a particular purpose.
- Non-infringement.
- Accuracy.
- Reliability.
- Availability.
To the fullest extent permitted by law, Homefix shall not be liable for indirect, incidental, consequential, special, punitive, or business-related damages.
Homefix's total liability shall not exceed the amount paid by the user for the specific service giving rise to the claim.
14. Data Collection Policy
Use of the Platform is also governed by the Homefix Privacy Policy. By using the Platform, users consent to the collection, use, disclosure, storage, and processing of personal information in accordance with applicable privacy laws.
15. Dispute Resolution
These terms shall be governed by the laws of Ontario and the federal laws of Canada.
Any dispute arising from the Platform or Homefix services shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
Where permitted by law, disputes may be resolved through binding arbitration in Ontario pursuant to the Arbitration Act, 1991.
16. Modifications to Terms and Conditions
- Homefix may revise, update, modify, or replace these terms at any time.
- Updated terms become effective immediately upon publication.
- Continued use of the Platform constitutes acceptance of revised terms.
